Notice of Claimed Infringement
If you believe that material available through a website, service, system, or network operated by Blue Matter Group, L.L.C. infringes a copyright that you own or are authorized to enforce, send a written notice to our designated DMCA agent.
To be effective, the notice should include substantially all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf.
- Identification of the copyrighted work claimed to have been infringed. If multiple works are covered by one notice, provide a representative list.
- Identification of the material claimed to be infringing, together with information reasonably sufficient for us to locate it, such as the specific URL or account location.
- Your name and contact information, including a mailing address and telephone number and, when available, an email address.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner’s behalf.
How We May Respond
When Blue Matter Group receives a notice that substantially complies with the applicable requirements, we may remove or disable access to the identified material and take reasonable steps to notify the person responsible for the material. We may request additional information when a notice is incomplete.
Counter-Notification
If material you submitted was removed or disabled because of a copyright complaint and you believe the removal resulted from mistake or misidentification, you may send a written counter-notification to the designated DMCA agent. A counter-notification should include substantially all of the following:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled and the location where it appeared before removal or disabling.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled because of mistake or misidentification.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the appropriate United States federal district court and will accept service of process from the person who submitted the original notice or that person’s agent.
After receiving a valid counter-notification, Blue Matter Group may provide it to the original complaining party and may restore the material not less than 10 and not more than 14 business days later, unless the designated agent first receives notice that the complaining party has filed a court action seeking to restrain the allegedly infringing activity.
Repeat Infringers
Blue Matter Group maintains a policy of terminating, in appropriate circumstances, accounts or access belonging to users or subscribers who are repeat infringers.
Misrepresentations
Anyone who knowingly makes a material misrepresentation in a notice or counter-notification may be responsible for resulting damages, costs, and attorneys’ fees. Consider consulting qualified legal counsel before submitting a notice or counter-notification.
